All creative content elements - artwork, graphics, client’s logos and designs provided to Publisher by Member for use on the HorizonWestHappenings.com website, web app, Facebook page or in printed publications and materials remains the ownership of the Member. Any content created for the Member’s listings or ads by the Publisher or created by Publisher using third party products or services, or any artwork, photos, sound, video, software or other materials obtained from third parties, which is incorporated into the site, app, Facebook or printed materials (“Third Party Materials”) by the Publisher is the ownership of Publisher. Components and parts that make up the final deliverable that are not provided by the client – remain the property of Publisher to be reused for its own and other client’s work as applicable.

11.4 ERRORS IN CONTENT
On occasion, a detail about a product, service or business listed on the HorizonWestHappenings.com website, web app, on Facebook or in print publications or materials may not be accurate due to an unintentional error or omission. Publisher reserves the right to unpublish the Member’s listing if it includes information deemed not suitable to display on our site or if the profile has no data, poor quality data or out-dated data. Publisher reserves the right to remove the Member’s cards or materials if they include information deemed not suitable to display, has poor quality or outdated information or if placed in an area not assigned to the Member’s materials. Publisher reserves the right to decline or reject any membership or content for any reason at any time without liability regardless of whether member was previously accepted.

11.6 LIMITATIONS OF LIABILITY
To the maximum extent permitted by law, under no circumstances shall Publisher, its subsidiaries, affiliates, officers, agents, owners, founders, representatives, employees, and contractors, jointly or individually be liable for any direct, indirect, punitive, consequential loss of income or profit, loss of confidential or other information, loss of privacy, personal injury, business interruption, or any other financial loss arising out of use of any services offered by Publisher, or for any incident, indirect, special or consequential damages, even if Publisher has been advised of these damages.
